Henry – I have inquired further about the issue of Mr. McGinnis’s knowledge of the Development agreement.    Assuming that he did know all about it, though.....if the City’s proverbial “ship” sailed long ago when they did a poor development agreement and failed to follow up....thought he development agreement did provide relief for the developer if the economy tanked.   All personalities and mistakes aside, staff and planning commission’s recommendation to give the new owner some time can be defended.

Unfortunately, your impatience with the story and heavy volunteering that you should be given the site to develop......which, as you know, would have its own HUGE set of legal complications that would be virtually impossible to surmount.....has not helped your campaign.

Not saying what my opinion is, or pre-declaring a vote.....that’s simply what I have heard and observed so far.   Probably not what you want to hear....but probably a similar story that you would get from others.

Open to something legal that would change that story.

Pull factor

Topeka needs to understand the pull factor. We "PULL" 34% of our sales tax from outside Shawnee County. We need that sales tax to survive. LOOK at the City budget and see how important sale tax is to our community. (click here to read more about the "pull factor")

Hello,

We have a client looking for the following. Please send me fliers for any buildings you have that fit the following criteria by Thursday, May 10 at 5:00.

Building Requirements:
  • Q2-Q4 occupancy – the client has mentioned they will likely need 4-6 months to set up the facility (tentatively May - August target)
  • Being operational by the end of 2018 is their goal
  • Single tenant facility is preferable (Other tenant’s uses may restrict ability to get their food grade certification)
  • Size – Minimum of 125,000 SF (125,000 – 170,000 SF preferably, slightly large is a possibility). A larger building may work if it meets all other requirements
  • Clear Height - 30’ CH min (their current clear height is 33’, but they will consider 30’). Dan will also look at high power, crane buildings as low as 22’ clear.
  • Power – they will need 4,000 AMPS min
  • 5-10 dock doors
  • 1 oversized drive in door (16’ x 18’)
  • Crane – potential for the facility to have a 10-20-ton crane
  • Floors – 8”, super flat
  • Silo pads – potential for 6 silos @ 100,000 lbs for their plastics resin

Important criteria to keep in mind:
  • This is a specialty plastics manufacturer that requires existing cranes in the facility or the potential to house cranes
  • The facility is likely going to need a dehumidification system installed
  • They are going to be pursuing food grade certification
  • Production will be running 24/7

We know now the original developer didn’t assign the development agreement at closing to the City of Topeka to the new owner.

The site plan is an exhibit to the development agreement that went through the TIF process. The stakeholders that approved the TIF are expecting 8 buildings to be build on the subject property.

The development agreement is in default; why wouldn’t the new owner not have to go back through the TIP process to amend the district?

Public monies were used to acquire the land, demo the improvement and add the infrastructure to make the site shovel ready for 8 townhomes. The community needs to hold the new owner accountable to the development agreement. It is the duty of the City to have the new owner sign the development agreement.

The development agreement issues and the Private Public partnership issues need to be cleaned up before planning could ever consider a zoning case to use a TIF district land for a Bark Park. If the new owner does not want to build on those 8 lots they should be offered to the public.

Mitigating the damages of a $310,000 shortfall in the TIF bonds should be paramount in the minds of the stewards of the public monies.
